Entering the National Phase of the PCT in Canada
Time limit: 30 months from earliest priority date.
Late entry may be effected up to 42 months from the earliest priority date (requires additional $200 government fee).
No excess claim fees in Canada.
Substantive examination may be delayed by up to five years from the filing date.
Documents Required:
- Copy of the application as published and sequence listing in computer-readable form.
- Assignment or other title document transferring ownership from the inventor(s) to the applicant and covering rights in Canada. A copy is acceptable as long as the original document was witnesses or notarized.
- Copy of the International Search Report (ISR), written opinion and any reply thereto would be helpful.
- Translation into English or French of the published application and any amendments filed under Articles 19 and/or 34.
- Names and addresses of all inventors and applicants.
An applicant who does not reside or carry on business at a specific address in Canada must appoint a representative and patent agent residing or carrying on business at a specified address in Canada.
