"First Filing" Patent Application for the Independent Inventor

The "First Filing" patent application process was developed to reduce the initial investment in a patent application, and to provide easier access to the patent system by independent inventors. This new procedure contains two steps.

A) Evaluation Report 

The features of the invention are identified.
A preliminary search is made in a patent database to determine the strongest point of invention and the scope of protection available for that feature.
A report is prepared to describe the prior art found during the search and to present facts to support the scope of protection that is anticipated.
The report is written in such a way that it can be presented to a bank manager, to business partners, to investors, or to government officials, for the purpose of obtaining support for filing for a patent and for developing the invention.

B) Preparing the Patent Application 

Before drafting the application, additional patent searches are carried out in all databases available at the USPTO, in the Canadian Patent Database, and in non-patent literature, to ensure with a high degree of certainty that the strongest point of invention is patentable.

he application is written using concise language, and it is focussed on a single invention.
The drawings are made free-hand. It is possible to replace these sketches with CAD drawings at a later date.
The patent application is filed in Canada as a formal application. It is possible to use this application as a priority document in the USA, or in an International Application with the PCT Office.

This "First Filing" patent application is less costly than a long-nurtured application.   It has, nevertheless, high quality and is prepared with efficiency and due diligence. The inventor maintains all his/her rights and privileges to obtain patents across the world.
