            Our Approach to Strong Patents TM

The expressions Patents by Design TM, and Patents by Design; Our Approach to Strong Patents TM are registered Trade-Marks of Mario D. Theriault & Co., to distinguish our method in preparing patent applications from the methods of others.

The expression Patents by Design was chosen to make a clear distinction from "Patent by Chance".  Some patent Applicants believe that there is more good luck than merit in obtaining a patent.  When patent applications are prepared according to this assumption, the specifications and claims often lack clarity and focus.

We, at Mario D. Theriault & Co., believe that all decisions made by Patent Examiners are very objective and are based entirely on Patent Laws and Rules. We believe that when a patent application is in compliance with Patent Laws and Rules, this application is always allowed.  Accordingly, we believe that it is possible to design a high quality patent application to confidently obtain a patent that has strong claims and a high commercial value.  This is always our objective.

Our Patents by Design method is summarized as follows in step form;
1)    Define the inventive concept clearly;
2)    Define the essential elements of the invention;
3)    Define the alternatives and equivalents;
4)    Define the potential infringers of this invention;
5)    Carry out an extensive patent search on the invention, in accordance with the latest Patent Office standards;
6)     Prepare a written disclosure that emphasizes on the essential elements of the invention and recites alternatives and equivalents;
7)    Prepare drawings that visually explain the invention at a first glance;
8)    Draft claims that are based on the essential elements of the invention but broad enough to cover the alternatives and equivalents;
9)     Draft claims to deter potential infringers;
10)    Submit the patent application to the Patent Office in a neat and appealing format, and deal with Patent Examiners in a courteous manner.

Advantages of this method are that patent applications are shorter, precise and easier to examine by the Patent Office.  The claims are concise, well supported and easier to defend in a court of law.  The commercial value of the patents granted is enhanced by the inclusion of an essential and broadly defined feature in each of their base claims.
